Terms of Service

These terms cover your use of Profilejar: making a page, getting tipped, and tipping someone else. We wrote them to be read. If something is unclear, ask us.

The short version

  • You own your page. You give us permission to host it and show it.
  • Tips go straight to your own Stripe account. We never hold them.
  • You keep 100% of every tip. The person tipping pays a service fee, shown before they pay.
  • No explicit content on Profilejar pages. Links to adult sites like OnlyFans are fine.
  • You must be 18 or older, or the age of majority where you live.

This short version is a summary. The full terms below are what apply.

1Who we are

Profilejar is run by [Company legal name], a company based at [address]. In these terms, "Profilejar", "we" and "us" mean that company. "You" means anyone who uses Profilejar, whether you have a page or you're tipping someone.

A "worker" is anyone with a Profilejar page who receives tips. A "fan" is anyone who visits a page or sends a tip.

By using Profilejar, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Profilejar.

2Who can use Profilejar

You must be at least 18 years old, or the age of majority where you live if that is higher, to make a page or to send a tip.

To receive tips, you must also be able to open a Stripe account in your country and meet Stripe's requirements.

You can't use Profilejar if we have banned you before, or if the law where you live doesn't allow it.

3Your account

You sign in with an email address and a password. Please:

  • Give us an email address you actually use.
  • Pick a strong password and don't share it.
  • Tell us right away through our contact page if you think someone else got into your account.

You are responsible for what happens under your account. Profilejar doesn't send email, so password resets go through our support team. We may ask you to prove the account is yours before we make any change.

One person, one account, unless you're on a team plan that says otherwise.

4Your page and content

You own it

Your photo, name, text and links belong to you. We don't claim ownership of anything you put on your page.

You give us permission to show it

So we can run Profilejar, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display and share your content, and to resize or reformat it as needed. This license covers running and improving Profilejar and showing your page to people who visit it. It ends when you delete the content or your account, except for backup copies kept for a limited time and anything we must keep by law.

You're responsible for it

You promise that you have the right to post everything on your page, and that it follows these terms and the law. Don't post someone else's photo, name or work without permission.

Copyright complaints

If you think something on Profilejar infringes your copyright, tell us through our contact page with enough detail for us to find it. We'll review it and remove content where appropriate.

5Acceptable use

Profilejar is for sharing your links and getting paid for real work. You may not use it to:

  • Break the law, or help someone else break it.
  • Pretend to be someone else, or mislead people about who is getting paid.
  • Harass, threaten or hurt anyone, or promote hate or violence.
  • Collect money for a fake cause, a scam, or anything you don't deliver.
  • Launder money, or move money for someone else.
  • Post malware, phishing links, or spam.
  • Get around our limits, scrape the site, or interfere with how it works.
  • Do anything Stripe doesn't allow. Stripe keeps a list of restricted businesses, and it applies here too.

Adult content

You may link to adult platforms such as OnlyFans from your page. You may not put explicit content on Profilejar itself. That means no nudity or sexual content in your photo, name, text, or link titles. Pages that break this rule will be taken down.

Anything involving minors in a sexual way is never allowed. We remove it and report it to the authorities.

We may review pages, remove content, or suspend accounts that break these rules, with or without notice.

6Handles and reserved names

Your handle is the name in your page's address. Picking a handle doesn't make it your property. We may take back or change a handle if:

  • It impersonates a person, brand or business, or infringes a trademark.
  • It's inactive for a long time.
  • It breaks these terms, or we're required to by law.

Some names are reserved and can't be picked, such as names used by Profilejar itself, common words, and well known brands. We decide what's reserved and may change the list at any time.

If we take back a handle that you're using in good faith, we'll try to tell you first and help you pick a new one.

7Tips and payouts

Tips go straight to you

Every tip is paid into the worker's own Stripe account. Profilejar never holds tips, and at no point does a tip pass through a Profilejar account.

We are not a bank

Profilejar is not a bank, a money transmitter, or a payment processor. We provide the page and the tip button. Stripe processes the payment and pays it out.

Tips are gifts

A tip is a voluntary payment from a fan to a worker. It doesn't buy anything and doesn't create a contract between the fan and Profilejar. Whether a worker's employer has rules about tips is between the worker and the employer.

Payouts

When and how tips reach your bank depends on Stripe and your Stripe settings. We don't control payout timing, and we can't release or hold a payout.

8The service fee

The worker keeps 100% of the tip. The fan pays a separate service fee on top of the tip.

The service fee is the card processing cost plus 5%, rounded up to a whole dollar. For example, the fee is $1 on a $5 tip, $2 on a $10 tip, and $9 on a $100 tip.

The fan sees the tip, the service fee and the total before paying. Nothing is charged until the fan confirms.

Profilejar keeps the service fee, after Stripe's card cost is paid from it. We may change the fee. A change applies only to tips made after it takes effect, and the fee is always shown before paying.

9Stripe

Payments on Profilejar are handled by Stripe. To receive tips, you must open a Stripe account through Profilejar and agree to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. Together these are the "Stripe terms".

The Stripe terms are between you and Stripe. Stripe may change them, and Stripe may review, pause or close your Stripe account under them.

You allow Profilejar to share information about you and your tips with Stripe, and to receive information from Stripe about your account and payments, so we can run the service.

10Refunds and chargebacks

Refunds

Tips are generally final. A worker may choose to refund a tip. If a tip is refunded, the tip comes out of the worker's Stripe account. Whether the service fee is refunded is up to Profilejar.

Chargebacks

A chargeback is when a fan asks their bank to reverse a payment. Because each tip is paid into the worker's own Stripe account, Stripe takes chargebacks and any dispute fees from that worker's account. The worker bears the cost of a chargeback, not Profilejar.

If you're a worker, you can respond to a dispute through Stripe. We may help where we can, but we don't decide the outcome.

If you're a fan and something went wrong with a tip, please contact the worker or contact us before going to your bank.

11Taxes

Tips are income to the worker. Workers are responsible for reporting their tips and paying any taxes owed. Profilejar doesn't give tax advice.

Stripe may collect tax information from you and may send tax forms to you or to tax authorities when the law requires it.

12Selling items

We plan to let workers sell items from their page. This isn't available yet. When it is, we'll add the terms that apply to buying and selling here, and they'll take effect as described in Changes to these terms.

Until then, the rules on tips apply only to tips.

13Teams and hotels

Businesses such as hotels, venues and restaurants can use a team plan to set up pages for their staff, so guests can tip them.

  • Each worker on a team still gets tipped into their own Stripe account. The business never receives or holds a worker's tips.
  • The business is responsible for having the right to set up and show pages for its staff, and for following employment and tip laws that apply to it.
  • A worker who leaves the team keeps their own Stripe account and their tips.

Team plans may come with a separate agreement. If they conflict, the separate agreement wins for that plan.

14Suspension and ending

You can leave anytime

You can stop using Profilejar and ask us to delete your account at any time through our contact page. Your Stripe account is separate, and you close it with Stripe.

We can suspend or close accounts

We may suspend or close your account, remove your page, or take back your handle if you break these terms, if Stripe or the law requires it, or if your use puts other people or Profilejar at risk. We'll usually tell you why, unless the law or safety says we shouldn't.

If you think we made a mistake, contact us and we'll take another look.

What lasts after

Sections that by their nature should last after your account ends will keep applying. These include ownership, refunds and chargebacks, taxes, disclaimers, limits on liability, indemnity and disputes.

15Disclaimers

We work hard to keep Profilejar running well, but we provide it "as is" and "as available". To the fullest extent the law allows, we make no promises beyond what's written in these terms, including promises that Profilejar will always be available, error free, or fit for a particular purpose.

Workers and fans are responsible for their own pages, links and payments. We don't check or vouch for any worker, any link on a page, or any site a link leads to.

16Limits on liability

To the fullest extent the law allows, Profilejar is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost tips, lost data or lost goodwill, even if we were told they might happen.

To the fullest extent the law allows, our total liability to you for any claim about Profilejar is limited to the greater of the service fees we kept on your tips in the 12 months before the claim, or [amount].

Some places don't allow some of these limits. Where that's the case, they apply only as far as the law allows.

17Indemnity

If someone brings a claim against Profilejar because of your page, your content, your tips, or your breaking these terms or the law, you agree to cover our reasonable costs of that claim, including legal fees, to the extent the law allows.

18Disputes

If you have a problem with Profilejar, please contact us first. Most issues can be sorted out quickly that way.

These terms are governed by the laws of [State], without regard to its conflict of law rules. Any dispute that isn't resolved informally will be handled in the state or federal courts located in [State], and you and Profilejar agree to those courts' jurisdiction.

19Changes to these terms

We may update these terms as Profilejar changes. When we do, we'll change the date at the top of this page. If a change is significant, we'll let you know on the site or when you sign in before it takes effect.

If you keep using Profilejar after a change takes effect, you accept the new terms. If you don't agree, you can stop using Profilejar and ask us to delete your account.
